Gather pgh LLC policy and procedures rental agreement

• Venue is not responsible for security or any damage to or the loss of any personal property or articles brought into the venue, or for any item left unattended, or for loss or damage which occurs in venue's parking areas. Client will accept full responsibility for any damages resulting from any action or omission of their individual attendees in conjunction with organized group activities. The venue is not responsible for any loss or damage no matter how caused, to any samples, displays, properties, or personal effects brought into the venue, and/or for the loss of equipment, exhibits, or other materials left in venue.

• Client covenants to be responsible for the consumption of alcoholic beverages by Client's guests and attendees at the event. Venue does not permit alcoholic beverages to minors as required by state law, and Client assumes the duty to ensure observance of this state statute. In the event Client has reason to believe a guest or attendee has become impaired to the extent they should not drive; Client assumes responsibility for said guest. Absolutely no alcohol is permitted to be sold at venue. Client agrees to uphold all Pennsylvania liquor laws and agrees to not serve to visibly intoxicated guests. A BYOB waiver must be signed by all clients. Gather pgh LLC encourages all clients to obtain event insurance with an alcohol liability insurance policy in addition to the waiver.

• Children must be under adult supervision. Client and parents assume the responsibility for minors.

• All events must end promptly at finish time.

• Decorations: All Clients must include set up and tear-down time in the rented time frame. Tape, tacks, and staples are NOT permitted for attaching decorations in venue. Confetti, paint, wax candles and loose glitter is strictly prohibited. $100 clean up fee will be charged to account if found. The renting party must remove all decorations by the conclusion of the rental and is responsible to return the rental space back to its original condition.

• Smoking is NOT permitted inside the venue. Outdoor smoking must occur at least 15 feet away from any facility entrance and must use proper disposal in receptacles. Violation of this rule will result in a minimum fine of $250 plus cost of any damages.

• Checks are not accepted: please use online booking tool. Gather pgh LLC reserves the right to collect a 20% security deposit depending on circumstances related to event booking.

• Date Changes/Cancellation Policy: Should you need to move the date of a reservation; every effort will be made by Gather Pgh LLC to accommodate the change based on availability. Because we stop offering reserved dates to other potential guests, event cancellations will result in a forfeiture of their initial deposit. Gather reserves the right to cancel any scheduled use due to acts of God, force majeure, or other unforeseeable circumstances. In such a case, every reasonable effort will be made to provide the Client with adequate advanced notice, and a full refund will be issued if necessary.

• Agreement: Client or caterer/vendor will provide all kitchen supplies (utensils, towels, dishes, tablecloths etc.). Caterers, bartenders, and organizers must be fully bonded and insured. Client shall also be responsible for all attorney fees and court costs required to recover payment and interest on the aforementioned invoice. Client is responsible for damages in accordance with the above terms. Client agrees to release Gather pgh LLC from all liability due to loss, theft, personal injury or property damages that may occur to any person or property thereon during the period of occupancy.

• Open flames are not permitted except for birthday candles and those used for specific food services. No deep fryers allowed.

• No animals of any kind are allowed on site. Violation of this rule will result in a minimum fine of $250 plus cost of any damages.

• No sexually explicit or drug use permitted. This is a family friendly site.

• When leaving venue:

• Remove any food/perishables from refrigerator
• Remove all decorations
• Wipe up any spills and throw all trash in dumpster. Extra bags are
  provided under sink.

By signing this document, I acknowledge and agree to the following:

• I have read and understand Gather pgh LLC Facility Rental Policy and event Information Packet in its entirety.

• I, as the renting party, shall have sole responsibility such that the event is orderly, contained within the agreed upon venue area, does not cause public disruption.

• I will uphold all Pennsylvania liquor laws and will not serve alcohol to the guests of my event if they are under 21 years of age, or visibly intoxicated.

• I, as an authorized representative of the renting party shall, to the extent permitted by law, indemnify and hold harmless Gather pgh LLC and their employees, representatives, agents and assign from and against claims, damages, losses, and expenses, including but not limited to attorney fees, arising out of or resulting from the Renter’s event(s). Gather pgh LLC will not be held liable for injuries or property damages/loss to others during the event, including but not limited to death, personal injury, property damage, or any other incidents that may occur to any person(s) by use of the building and premises during the terms of the agreement. The term of the agreement starts when the first representative (guest) arrives on the property and concludes when the last person leaves the property
